GENERAL CONDITIONS

The purpose of these general terms and conditions of sale is to regulate the purchase of products carried out remotely and made available through the internet network from the website www.apitaly.it (hereinafter, the "Online Shop") in compliance with the Italian legislation set forth in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the "Consumer Code").

The seller of the products and owner of the Online Shop is: Apicoltura Roberto Marcenta with registered office in Via San Lorenzo 46/A - 35031 Abano Terme (PD), Tax Code/ VAT number and registration with the Companies' Register of Padua no. 454225 - E-mail address: info@apitaly.it .

The consumer who accesses the Online Shop to make purchases (hereinafter the "Customer") is obliged to read these General Conditions carefully before sending the order. The sending of the order confirmation implies, therefore, the full knowledge and acceptance of the a.m. conditions. The contracts concluded with Apicoltura Roberto Marcenta through the Online Shop are regulated by these General Conditions in compliance with the Italian law.


INFORMATION ON THE PRODUCTS

The information and characteristics relevant to the Products are available in the Online Shop. The visual representation of the Products in the Online Shop, where available, normally corresponds to the picture provided for the description. It is understood that the image of the Products has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and quality but may differ in colour and size. In the event of a difference between the image and the written product sheet, the description of the product sheet shall always prevail. 


PRICES AND SHIPPING

The prices of the products are inclusive of all taxes and duties. All prices are in Euro.

Shipping in Italy:

The shipment will be made by express courier with transport cost according to the following conditions: weight, volume and number of products purchased. The fresh Royal Jelly will be shipped throughout Italy with the exception of Calabria, Sicily and Sardinia.

Shipments abroad:

shipments abroad are exclusively related to the products of Natural Thermal Cosmetics and will be made by express courier with transport cost according to the following conditions: weight, volume and number of products purchased.

Before confirming the purchase, the Customer will be given a summary of the unit cost of each product chosen, the total in the case of more than one product and the relative transport costs.


PAYMENT METHODS AND INVOICING

The Customer may pay the price of the Products and the relative delivery costs by PayPal or bank transfer.

PayPal

Once the order has been confirmed, the Customer will be redirected to the PayPal website where he/she can make the payment with his/her account or using a card, even a prepaid card, or in any case according to the methods accepted by PayPal and in compliance with its conditions.

In fact, through PayPal it is possible to pay even if you do not have a PayPal account, using the credit cards accepted by the PayPal circuit.

Bank transfer

The Customer shall make the bank transfer within 3 working days from the date of the order. If this does not occur, the order shall be cancelled and the goods shall be made available again for purchase by other Customers. Customers who have not made the transfer may be contacted by Customer Service in order to clarify whether the cause of the failure to credit is due to the customer's desire not to confirm the purchase or other causes.

Purpose of transfer: the Customer must specify the date and the order number, which can be found in the confirmation email.

Invoicing of orders

If the Customer asks for an invoice, it will be possible to request one by selecting the appropriate box during the order process and entering the invoicing data including tax code and/or VAT number. In this case, the invoice will be sent by email to the address indicated. The Customer is responsible for the correct insertion of the invoicing data and is expressly informed that, in case the invoice is not requested during the order process, you won’t be able to request it later.

Shipping and delivery

The Products purchased in the Online Shop shall be delivered to the address given by the Customer during the purchase procedure in the specific "Shipping Address" field.

All purchases shall be shipped by express courier from Monday to Thursday, excluding public holidays and national holidays. Apicoltura Roberto Marcenta is not responsible for delays that cannot be foreseen or attributed to it.

For orders received and confirmed from Monday to Thursday, if all the items mentioned in the order are available in the warehouse, shipment will take place within 24/48 hours from receipt of the order.

All orders successfully processed after 12:00 noon on Thursday will be shipped on the following Monday, if not a public holiday.

Once all Products have been shipped, the Customer will receive a confirmation email which will include a link for tracking the shipment.

However, except in cases of force majeure or unforeseeable circumstances, all Products ordered will be shipped within a period of 7 (seven) working days starting from the day following that on which Apicoltura Roberto Marcenta confirmed the order to the Customer through an order confirmation email.

The delivery of the order shall take place:

- in Italy within 48/72 hours (working days) from the date of shipment except for Calabria, Sicily and Sardinia for which destinations are needed 72/96 hours;

- abroad in 3/5 working days.

The delivery service foresees 1 (one) delivery attempt at the address given during the order process. Should this attempt fail, the Customer has the possibility to arrange redelivery: GLS's computer system automatically sends an email to the recipient with a dedicated link where to access. The recipient has 5 (five) working days to click on the link and plan the date and time of redelivery. If also in this case the delivery is not successful, the products sent will be stored for a maximum of 10 (ten) days after which, in case of non-collection, the product purchased will be sent back to Apicoltura Roberto Marcenta. The costs of storage and return as well as the responsibility of the goods put in storage, for reasons not attributable to Apicoltura Roberto Marcenta, are charged to the recipient. 


RIGHT OF WITHDRAWAL

Apicoltura Roberto Marcenta guarantees the right of withdrawal for any reason from the purchase contract. To exercise this right you must send a registered letter with return receipt or an e-mail specifying the order number and which products are subject to return. This must be done within 10 (ten) days of receipt of the goods. Products can be returned by delivery of the package to the courier at the applicant’s expense.

To whom does the right of withdrawal apply?

Under current Italian law, the right of withdrawal can only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to any commercial activity. The right of withdrawal, therefore, cannot be exercised by legal persons and natural persons acting for purposes linked to a commercial activity. All purchases carried out by retailers or persons who in any capacity purchase for resale to third parties are excluded from the right of withdrawal, as well.

I. Conditions for exercising the right of withdrawal

The right of withdrawal shall be deemed properly exercised if the following conditions are met in full:

1. the products must not have been used, washed or damaged;

2. the products must have an intact label; 

3. the products must be returned in their original packaging;

4. the returned products must be sent to Apicoltura Roberto Marcenta in a single shipment;

5. the returned products must be delivered to the courier within 10 (ten) working days from the date on which you received the products.

All items must be returned to:

If all the required conditions have been met, Apicoltura Roberto Marcenta will refund the price of the purchased products, excluding the amount paid for shipping costs if paid.

If the return cannot be accepted because it does not comply with the above conditions, the Customer will be contacted and, in this case, may choose to return the purchased products at his own expense. In case he refuses this shipment, Apicoltura Roberto Marcenta reserves the right to retain the products and the corresponding amount for the purchase of the products.

II. Time and method of reimbursement

After Apicoltura Roberto Marcenta has received the return and checked that all requirements have been met, the Customer will get an e-mail confirming acceptance of the return. The refund will be carried out by Apicoltura Roberto Marcenta as quickly as possible, and in any case within thirty (30) days from the date on which it has learned of the exercise of the right of withdrawal, once you have verified that the withdrawal has taken place in accordance with the above conditions.

The period for the re-crediting or refund of the sums paid by the Customer for the purchased products depends on the payment method used:

- purchase by credit/debit card: the time it takes to view the reimbursement depends on the issuing bank.

- purchase via PayPal: the refund will be made to the Customer's PayPal account and will be immediately visible. The actual refund to the credit card from the Customer's PayPal account depends on the issuing bank.

For gift orders, the refund will be made to the person who made the payment.

III. Courier for returns

The payment of the return shipment must be carried out by the customer himself and he shall remain liable for any loss or damage of the products during transport.

Any dispute between the parties in this regard will be decided by the Court of Padua (Pd).
